Playground equipment to include the tire swing, wooden climber with slide, slide off the deck, dome jungle gym, and monkey bars (horizontal ladder) are not installed following CPSC playground safety guidelines. They do not have adequate use zones and fall material. Other materials are placed within the use zones. The monkey bars are intended for childred over 4 years old.

Any requirement to remove and replace all of the equipment that now may not comply to newer rules and the arbitrary enforcement, would cause a severe hardship as the cost would be prohibitive. Fall zone surfacing material will be upgraded within ten days, allowing for scheduling. We would choose to dispute the requirement to rebuild the playground based on the prior inspections and acceptance by DCYF. (12) Licensor reviewed MERIT and observed that Center Aide TH (employed 4 mo.), Center Director AM (employed 11 years and 11 mo.), Center Assistant Teacher PO (employed 7 mo.), and Center Assistant Teacher Claire Sullivan (employed 1 year 9 mo.) have not completed the required Childcare Basic Training within 3 months of employment.
