This requirement is not met as evidenced by: Based on interviews and record reviews, the facility did not comply with the section cited above in that the facility left a child in care in a soiled diaper long enough for the pants to become soiled, which posed a potential health, safety, or personal rights risk to persons in care.

ALLEGATION(S): -The Center refused to accept the children after receiving negative COVID-19 test results. -The staff took the children's lunch away and did not provide substitute food. INVESTIGATION FINDINGS: Licensing Program Analyst (LPAs) Van and Leong conducted an unannounced subsequent complaint investigation to deliver the findings and met with the site Director, A.S. LPAs explained the purpose of the inspection and were granted entry to the facility by the staff. Present, 26 teachers are supervising 91 children. The facility is operating within the teachers/children ratio. LPAs toured and inspected the facility for health and safety hazards. As part of this complaint investigation, the complainant, parents, and staff were interviewed; records and relevant information were obtained and reviewed. Regarding the allegation that the Center refused to accept children back after receiving negative COVID-19 test results. It was found that there were two separate occasions where the facility requested COVID test results from the family. The first was when children returned from Winter break, and the second request stemmed from a Social Media post where a parent posted that their children tested positive for COVID-19. The Center requested documentation and negative tests from the family, which according to K.W., Chief Community Officer, the Center never received. Based on interviews and facility COVID-19 Handbook Supplement. The facility implemented its COVID protocol/procedure in accordance with Local, State guidelines, and CDC recommendations.
